Trump considered on his social network, Truth Social, that the special prosecutor in charge of the investigation, the “demented” Jack Smith, filed this charge “ridiculous in an effort to resurrect a ‘dead’ witch hunt in Washington DC in an act of desperation and face-saving.”

The special counsel investigating Donald Trump over his attempts to overturn the 2020 election results filed a new charge against the former US president on Tuesday, narrowing the allegations to align with the Supreme Court ruling.

Jack Smith struck a section that addressed Trump’s interactions with the Justice Department, an area in which the Supreme Court, in a 6-3 opinion, said Trump was entitled to immunity from prosecution.

The document, which contains the same four charges as the previous one, issued on August 1, 2023, “reflects the desire of the Public Prosecutor’s Office to respect and apply the conclusions and instructions of the Supreme Court”, specified Peter Carr, spokesman for the Department of Justice, in a statement quoted by the Agence France-Presse (AFP).

Donald Trump therefore continues to be accused of “conspiracy against American institutions” and of “undermining the right to vote” of voters by putting pressure on local authorities in several key states in order to invalidate the official results of the elections won by Democrat Joe Biden.

In a landmark decision released on July 1, the U.S. Supreme Court recognized broad criminal immunity for the President of the United States.

By a majority of six votes to three — conservative judges against progressive ones — the country’s highest court ruled that “the president does not enjoy any immunity for his unofficial acts,” but that “he is entitled to at least a presumption of immunity for his official acts.”

The case was then returned to Judge Tanya Chutkan, who will determine which acts are potentially immune from criminal prosecution.

The updated criminal case no longer lists Jeffrey Clark, a Justice Department employee who supported Trump’s false claims of election fraud, as a co-conspirator, the Associated Press reported.

The special counsel’s office said the updated indictment, filed in federal court in Washington, was issued by a grand jury that had not previously heard evidence in the case.
